These Terms and Conditions govern your use of Excerpt, an iOS application published by Octet Méditerranée, and of the Excerpt Premium subscription. By downloading or using Excerpt, you agree to them. If you are a consumer, nothing in these terms removes rights you have under mandatory law.

Use of the app

Excerpt is provided for personal, non-commercial use. You may use Excerpt to import, play, highlight, annotate, and manage audiobook files that you have the right to use.

You are responsible for ensuring that any audiobook files you import into Excerpt are content you are lawfully permitted to use. Excerpt does not verify the ownership or licensing of imported files.

Intellectual property

Excerpt and its original content, features, and functionality are owned by Octet Méditerranée. All rights are reserved.

Audiobook files imported into Excerpt remain subject to the rights of their respective owners. Excerpt does not grant you any rights to audiobook content you import.

Content from LibriVox and Project Gutenberg

Excerpt can browse and download public-domain audiobooks from LibriVox, and can automatically fetch the matching e-book from Project Gutenberg when you import one. That content is in the public domain or made available under open licences, and you are responsible for complying with any licence terms that apply where you live. Excerpt is not affiliated with, endorsed by, or sponsored by LibriVox, Project Gutenberg, or the Internet Archive, and cannot guarantee that their services will be available or that any particular title can be found or matched.

Excerpt Premium

Excerpt is free to download and use. Excerpt Premium is an optional paid subscription that unlocks the higher-quality on-device transcription models, AI clean-up of transcripts, and unlimited EPUB matching. Without Premium, Excerpt provides the standard transcription engine and one EPUB match.

Billing and auto-renewal

Excerpt Premium is an auto-renewing subscription sold and processed by Apple through the App Store. The price, the subscription period, and the applicable taxes are shown in the app and on the App Store before you confirm the purchase; they are not reproduced here, because Apple sets them per territory and they can change.

Payment is charged to your Apple Account on confirmation of purchase. The subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends, and your account is charged for renewal within 24 hours before the end of the current period. Apple, not Octet Méditerranée, takes the payment. We receive no payment details.

Apple may change the price of a subscription. Where it does, Apple will notify you and, where required, ask for your consent before the new price takes effect.

Cancelling

You can cancel at any time in Settings → your Apple Account → Subscriptions on your device, or through the App Store. Cancelling stops the next renewal; it does not end the period you have already paid for, and Premium remains active until that period expires. The subscription cannot be cancelled from inside Excerpt, because Excerpt does not control the billing relationship — Apple does.

Refunds

Refunds for App Store purchases are handled by Apple under Apple's Media Services Terms and Conditions, using Apple's request-a-refund process at reportaproblem.apple.com. Octet Méditerranée cannot issue, approve or reverse a refund for an App Store purchase, and has no access to your purchase history. This does not affect any statutory right you have as a consumer.

If your subscription ends

When a subscription lapses or is cancelled, Premium features stop being available: transcription reverts to the standard engine, AI transcript clean-up becomes unavailable, and EPUB matching returns to the free allowance. Nothing you already created is deleted — your books, highlights, transcripts and EPUB matches remain in the app. Any Premium transcription models already downloaded to your device may remain on it, and you can delete them from the app's settings. Resubscribing restores Premium features.

Right of withdrawal (EU consumers)

If you are a consumer in the European Union, you have a statutory right to withdraw from a distance contract within fourteen days. For purchases made through the App Store, the seller is Apple, and Apple administers that right through its own cancellation and refund process — see Apple's Media Services Terms and Conditions and reportaproblem.apple.com. By purchasing Excerpt Premium you request that access to the digital content begins immediately; where performance has begun with your express prior consent, the right of withdrawal may lapse under Article L221-28 of the French Consumer Code and the equivalent provisions in other Member States. Because Octet Méditerranée is not a party to the sale, any withdrawal request must be made to Apple.

Third-party services

Excerpt relies on services operated by others: Apple (iCloud, speech recognition, Apple Intelligence, the App Store), LibriVox and its download hosts, Project Gutenberg, Hugging Face for model downloads, and Readwise if you connect it. Those services have their own terms, are outside our control, and may change, break or shut down. Octet Méditerranée does not warrant their availability or accuracy and is not responsible for their acts or omissions. Where you connect Readwise, you are responsible for your own Readwise account and for keeping your API token confidential.

iCloud and your data

Excerpt syncs your library through your own private iCloud account. That data is held by Apple under Apple's terms, and Octet Méditerranée has no access to it and cannot recover it for you. You are responsible for maintaining your own copies of anything you cannot afford to lose. See the Privacy Policy for what syncs and how to turn it off.

Exports and backups

Excerpt may allow you to export audiobooks, highlights, annotations, metadata, or backups. You are responsible for how you use, store, or share any content you export from the app.

Disclaimer of warranties

Excerpt is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Octet Méditerranée does not warrant that the app will be uninterrupted, error-free, or free of harmful components.

Speech-to-text and AI clean-up produce approximations. Transcripts, EPUB matches, and AI-corrected text may be inaccurate, incomplete, or wrong, and should not be relied on as an accurate record of what was said or written. You are responsible for checking any transcript before you rely on it, quote it, or publish it.

You use Excerpt at your own risk. Octet Méditerranée is not responsible for any loss of audiobook files, highlights, annotations, or other data that may result from use of the app.

Limitation of liability

To the fullest extent permitted by applicable law, Octet Méditerranée shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Excerpt.

Changes to the app

Octet Méditerranée may update, modify, or discontinue Excerpt or any part of it at any time without notice. If a feature included in Excerpt Premium is materially reduced or withdrawn during a period you have paid for, you may cancel and seek a refund from Apple as described above.

Changes to these terms

These Terms and Conditions may be updated from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of Excerpt after changes are posted constitutes acceptance of the revised terms.

Apple

These terms are between you and Octet Méditerranée only, not with Apple. Apple is not responsible for Excerpt or its content. Octet Méditerranée, not Apple, is solely responsible for Excerpt, for any maintenance and support, and for addressing any claim that Excerpt or your use of it infringes a third party's intellectual property rights or fails to conform to any applicable legal or regulatory requirement. Apple has no obligation to provide any maintenance or support for Excerpt.

In the event Excerpt fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Excerpt, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the responsibility of Octet Méditerranée.

By using Excerpt you represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right to enforce them against you.

Governing law and consumer rights

These terms are governed by the laws of France, without regard to conflict of law provisions. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.

In the event of a dispute, please contact us first at contact@octetmediteranee.eu. Purchases of Excerpt Premium are made from Apple, so complaints about billing, renewals or refunds should be directed to Apple.
